Ventura—The Board of Supervisors, on Tuesday, December 16, approved its agreement with the County Employee Retirement Association amendment of bylaws and regulations to remove the 1999 disability and procedures.
During public comments Ventura County Employees’ Retirement Association (VCERA), Retirement Administrator Amy Herron, said their updated bylaws have been approved by its board.
The amendment includes the detachment of the disability procedures.
“The DHPs are administrative procedures that guide the hearing procedures and guide the hearing process and related guidelines for disability retirement applications,” he said. “The DHPs are now outdated, and many provisions are no longer necessary due to investigations being conducted by VCERA’s staff.”
She said the problem with having the DHPS attached to the bylaws is that it gives the Board of Supervisors ultimate veto power of any changes VCERA’s Board of Retirement wants to make to properly administer the system.
“This is a governance issue, and in direct conflict to the Board of Retirement’s Trust Fund and its members,” she said. “The Board of Retirement under the California Constitution has the authority over the administration of the system and its benefits, and not correcting this conflict creates risk not only for the Board of Retirement and the…
