Oxnard—During its Tuesday, Feb 10, Public Works & Transportation meeting, the body received its Annual Enterprise Pavement Impact Cost Reimbursement Study.
Committee Member Gabby Basua made the motion, which Mayor Pro Tem Gabe Teran seconded.
Public Works Director Michael Wolfe presented the item and said the water, wastewater, and Solid Waste funds have transferred money through its infrastructure use fee transfer (IUF), which transfers money to the General Fund.
“That was done utilizing a 2014 report done by HF&H, an Enterprise Allocation Study,” he said. “That study calculated the Enterprise’s share of Public Safety, Police and Fire, Governmental facilities, and right-of-way pavement maintenance. The report calculated its fair share of the areas and calculated a transfer of funds to the General Fund.”
In 2014, he said a lawsuit indicated the IUF Transfer violated the California Constitution, article 13 D.
“In 2021, there was a judgment that agreed with and indicated the City needed to cease the IUF Transfer not only going forward but also as years go backward so the City can get reimbursed for those Enterprise Funds,” Wolfe said. “They also stop the transfer going forward and reduce the waste wastewater and solid waste rates.”
